Is USDT safe to hold? It depends which risk you weigh: reserves, Tether's freeze powers, or the contracts and chains it runs on.
First, reserves. Tether's September 30, 2026 report, assured by BDO, shows assets 7.95 billion dollars above liabilities. About 64 percent of assets were Treasury bills.
But assurance is not a full audit. BDO covers one date only, assumes normal markets, and excludes Tether's background notes.
Second, freeze risk. On Ethereum, USDT's owner, a three of six multisig, can blacklist any address so it cannot send, then destroy its balance.
Tether's terms allow freezes when required by law, on a breach, or when Tether judges it prudent. On November 2, it said it had frozen over 7 billion USDT.
Third, contract and chain risk. Tether lists 13 chains, each with its own code and controls, and USDT0 adds bridge risk. In August 2025, a queued Polygon migration would have left USDT0 under-backed, and it was fixed before the transactions ran.
Two January 2027 deadlines may limit where platforms offer USDT: the GENIUS Act's foreign issuer rule in the US, and ESMA's call to end non-MiCA stablecoin services in the EU.
Run your own checks: read the assurance report, name your version, read the controls, screen addresses before sending, and know your exit.

USDT is a claim on Tether. Its value rests on the reserves behind it, the powers Tether keeps over it, and the contracts it runs on.
This guide gives no verdict on whether USDT is safe. It lays out each risk with its source and date, and the checks you can run yourself.
Claims about Tether come from its reports, regulators, Reuters and chain state.
Reserves and Attestations
Each quarter, Tether publishes a Financial Figures and Reserves Report for Tether International, S.A. de C.V., the company that issues USDT.
The latest covers September 30, 2026. BDO Advisory Services S.r.l., in Milan, signed its assurance report on October 30, 2026.
BDO performed a "reasonable assurance engagement" under ISAE 3000 (Revised). It concluded that the report is, "in all material respects, fairly presented" against the criteria the report sets out.
Assets were $191.45 billion and liabilities $183.50 billion, leaving $7.95 billion of excess. The assets:
| Asset | US$ billions | Share |
|---|---|---|
| US Treasury bills | 122.84 | 64.2% |
| Reverse repos, overnight and term | 16.70 | 8.7% |
| Precious metals | 19.08 | 10.0% |
| Secured loans | 14.18 | 7.4% |
| Bitcoin | 8.37 | 4.4% |
| Other investments | 6.00 | 3.1% |
| Public equities | 4.18 | 2.2% |
| Cash, deposits, bonds, other bills | 0.11 | 0.1% |
Shares are our arithmetic. Tether says its secured loans are "over collateralized by assets, subject to margin call and liquidation mechanisms."
What the report does not cover
Assurance on a reserves report is not a full audit. ISAE 3000 (Revised) is the standard for "Assurance Engagements Other than Audits or Reviews of Historical Financial Information."
BDO states its own limits:
- One moment. It gives no assurance "at any other date or time" than September 30, 2026.
- Normal markets. Valuations do "not reflect unexpected and extraordinary market conditions," or key custodians becoming illiquid.
- The notes. Tether's background notes, including its list of chains, carry no assurance.
- Litigation. A New York class action over the 2017 and 2018 bitcoin price drop is pending, with no provision.
Tether's report also says its 2025 financial statements were audited. It does not name the auditor.
Our proof of reserves guide covers why point-in-time reports fall short of audits.
Events on the Record
| Date | Event | Outcome |
|---|---|---|
| Feb 23, 2021 | New York Attorney General settles with Tether and Bitfinex | $18.5M penalty; no more trading with New Yorkers |
| Oct 15, 2021 | CFTC order on misleading reserve claims | $41M penalty for Tether; $1.5M for Bitfinex |
| Nov 26, 2025 | S&P Global Ratings cuts its USDT assessment | 5 (weak), its lowest score |
| Oct 29, 2026 | Binance hack | Tether says it froze over $1.5B within 30 minutes |
New York's Attorney General found that by mid-2017 Tether "had no access to banking, anywhere in the world," and that for periods tethers were not fully backed.
The CFTC found Tether held enough fiat reserves on "only 27.6% of the days in a 26-month sample time period from 2016 through 2018."
It also found Tether "relied upon unregulated entities and certain third-parties" to hold reserves.
S&P cited higher-risk reserve assets, including bitcoin, gold, secured loans and corporate bonds, and "persistent gaps in disclosure," Reuters reported.
Tether said it "strongly disagrees with the characterization presented in the report."
Freeze and Blacklist Powers
Tether can stop an address from moving USDT. The power helps victims of theft, and it reaches every holder.
On Ethereum, USDT's owner calls addBlackList on an address. The address can no longer send USDT, and destroyBlackFunds can then zero its balance.
We read the owner at Ethereum block 26,357,581 on November 6, 2026. It was a MultiSigWallet contract needing 3 of its 6 signers.
On Solana the same day, USDT's mint and freeze authority was one SPL multisig needing 2 of 3 signers.
Tether's Terms of Service (updated February 26, 2026) allow freezes in three cases.
- when required by law;
- when Tether "determines it is prudent to do so"; or
- when a holder breaches the Terms.
On November 2, 2026, Tether said it had frozen more than 7 billion USDT and returned about 1.2 billion through reissuance.
The functions line by line are in USDC and USDT freeze functions explained.
Contract and Chain Risk
USDT is not one contract. Tether's report lists 13 chains where its tokens are currently issued, from Ethereum and Tron to Solana and Aptos.
Each deployment has its own code, owner and freeze mechanics.
On Ethereum, USDT is not a proxy. Its owner can call deprecate to forward calls to a new contract, but that switch was off when we read it.
USDT0 is separate
USDT0 is the omnichain deployment of USDT, built on LayerZero's OFT standard and live on more than 25 chains. It runs on its own contracts.
That adds bridge risk: the peers, verifiers and multisig that connect each chain.
In August 2025, a queued Polygon migration would have left more USDT0 circulating than USDT backing it. It was caught in review and fixed before the transactions ran.
Any other bridged copy adds its own bridge's risk.
Regulation in the US and EU
Two deadlines fall in January 2027.
United States
Tether's report describes USDT's issuer as an El Salvador company. Section 3(b)(2) of the GENIUS Act covers coins from foreign issuers.
It bars platforms from offering them in the US unless the issuer "has the technological capability to comply, and will comply" with lawful orders.
The ban applies from the Act's effective date, which the OCC's final rule puts at January 18, 2027.
In January 2026, Tether said USDT is "progressing towards GENIUS Act compliance." It launched USAT for the US market, issued by Anchorage Digital Bank, N.A.
What is still open is in Is USDT GENIUS Act compliant?
European Union
Announcing its opinion on October 8, 2026, ESMA said CASPs "should cease providing services related to non-MiCA-compliant stablecoins to clients in the European Union."
Supervisors should require remaining exposures to be fixed within three months, by January 8, 2027. The opinion names no token.
ESMA's register of e-money token issuers, last updated November 5, 2026, lists Circle Internet Financial Europe SAS but no Tether entity.

Checks to Run Yourself
- Read the assurance report itself. Check its date, scope and stated limits, not just the press release.
- Track the reserve mix. Compare Treasury bills with metals, bitcoin and loans each quarter.
- Name your version. Native USDT on which chain, USDT0, or another bridge's copy.
- Read the controls. Owner, threshold and upgrade path on each chain you hold. Alert on changes.
- Screen before sending. On Ethereum, call
isBlackListedon the destination first. - Know your exit. Direct redemption needs a verified Tether account and $100,000 minimum; the fee is the greater of $1,000 or 0.1%.
- Ask your venues. Find out what each exchange and custodian will change for USDT in January 2027.
How Guardian Helps
Guardian's deployment verification matches deployed proxies, implementations and admins byte-exact against the audited source. It confirms every privileged address against the intended multisig.
It also decodes and simulates queued multisig transactions, and verifies supply migrations before they run.
For a stablecoin you plan to list, Guardian reads every deployment, role and upgrade path. See the USDT0 deployment verification case study.
Frequently Asked Questions
Is USDT backed 1:1?
Tether's September 30, 2026 report, assured by BDO, shows $191.45 billion of assets against $183.50 billion of liabilities. About 64% of assets were US Treasury bills; the rest includes repos, gold, secured loans and bitcoin.
Can Tether freeze my USDT?
Yes. On Ethereum, USDT's owner can blacklist any address so it cannot send, then destroy its balance. Tether's terms allow freezes when required by law, on a breach, or when Tether judges it prudent.
Is Tether audited?
BDO gives reasonable assurance on its quarterly reserves report under ISAE 3000 (Revised), a standard for engagements other than audits. Tether says its 2025 financial statements were audited but does not name the auditor.
Is USDT allowed in the EU?
ESMA said on October 8, 2026 that CASPs should stop services for non-MiCA-compliant stablecoins and fix remaining exposures within three months. It named no token. No Tether entity appears in ESMA's e-money token register.
