The GENIUS Act takes effect January 18, 2027. Rules were due by July 18, 2026, and only the OCC's issuer rule is final.

The Act was signed July 18, 2025. The OCC's final rule followed in October 2026. From July 18, 2028, platforms are limited to permitted issuers' coins.

Regulators did not meet the July 2026 deadline. Federal Reserve, FDIC and NCUA issuer rules are still proposals, and the Committee's state certification rule is interim final.

Section 20 picks the earlier of two triggers. Eighteen months after enactment is January 18, 2027. Counting 120 days from the OCC's October rule lands later.

From January 18, 2027, issuing without approval carries criminal penalties, the OCC says. OCC applicants may request a waiver of up to 12 months if a substantially complete application is pending by then.

Also still open: BSA and sanctions rules, the joint customer identification rule, Treasury's issuance rule with its foreign issuer test, section 18 comparability determinations, and OMB approval of the OCC's forms.

In Guardian's reading, comment on the Fed proposals by November 30. By January 18, have a substantially complete application if you need a waiver, plus a board-approved security program and tested key recovery. Reconcile OCC reports against onchain supply.

Guardian maps your activities and evidence to these provisions, with your counsel. Read the full timeline, or talk to Guardian at guardian.security.

The GENIUS Act became law on July 18, 2025. Its rules come from the OCC, the Federal Reserve, the FDIC, the NCUA and Treasury, each on its own schedule.

This page lists each step with its Federal Register citation, comment date and status as of November 5, 2026. Rule dates are Federal Register publication dates.

This article explains the technical and security side of the GENIUS Act and its implementing rules. It is not legal advice; confirm how it applies to you with counsel.

The Committee is the Stablecoin Certification Review Committee, which reviews state regulators' certifications.

Its interim rule is in effect, but it will accept certifications only after Paperwork Reduction Act approval.

Treasury's issuance proposal covers how US platforms may treat foreign issuers' coins. See Is USDT GENIUS Act Compliant? for that test.

Proposed 31 CFR 1033.240 in the FinCEN and OFAC proposal would implement the freeze and lawful order duties. Our post on GENIUS freeze mandates and the SEC's central party test covers them.

How the Effective Date Works

Section 20 of the Act sets the effective date as the earlier of two dates:

  • 18 months after enactment: January 18, 2027.
  • 120 days after the primary federal regulators issue any final regulations.

The OCC's rule is the first final rule from a primary federal payment stablecoin regulator. Counting 120 days from it lands after January 18.

So the OCC concludes that January 18, 2027 "will be the effective date of the Act."

Existing issuers and waivers

From January 18, 2027, issuing a payment stablecoin in the US without approval carries criminal penalties, OCC Bulletin 2026-51 says. The Act has no compliance implementation process for issuers already operating.

  • Section 5(f) allows waivers for up to 12 months from January 18, 2027.
  • OCC applicants may request one if a substantially complete application is pending by then (12 CFR 15.30(g)).
  • The OCC sees general grounds to waive only the approval requirement, and only for issuers already operating in the US.
  • Applications open once OMB approves the OCC's forms. The OCC will announce it by press release.
  • The Act's 120-day decision clock starts no earlier than January 18, 2027, the OCC says.

What Is Still Open

Still to come, as of November 5, 2026:

  • Final FDIC, NCUA and Federal Reserve rules for the issuers they supervise.
  • BSA and sanctions rules from the OCC, the FDIC, and FinCEN and OFAC.
  • The joint customer identification program rule.
  • Treasury's issuance, offer and sale rule, including the foreign issuer test.
  • Treasury's state similarity principles and the Committee's final forms.
  • OMB approval of the OCC's application and reporting forms.
  • OCC guidance, which may cover change management and information security.

Treasury's section 18 comparability determinations for foreign regulations are also pending. The OCC's final rule says they "have yet to be made."

What to Have Ready

The dates come from the texts above; what to have ready is Guardian's reading.

By November 30, 2026

  • Comments on the Federal Reserve proposals (Dockets R-1899 and R-1900).
  • Comments on the Committee's interim certification rule.
  • Comments on the OCC's application and reporting forms, by November 23.

By January 18, 2027

  • A substantially complete application, if you will need a waiver.
  • For OCC issuers, a board-approved IT and security program under 12 CFR 15.13(b).
  • Key management, backup and recovery, with a recovery you have performed.
  • The technological capability to comply with lawful orders (section 4(a)(6)(B)).
  • For platforms, a diligence file on each foreign issuer's coin (section 3(b)(2)).

By the first report dates

OCC issuers file weekly activity and reserve reports (form PS-01) and quarterly condition and income reports (PS-02). Both start in the first quarter of 2027, subject to OMB approval.

Feed them from systems you can reconcile against onchain supply on every chain.

By July 18, 2028

Platforms may offer only coins from permitted issuers, or from foreign issuers that qualify under section 18. FinCEN's guidance and rules on detecting illicit activity are also due.

How Guardian Helps

Guardian's Regulatory & Compliance assessments map your activities to the provisions that reach them, confirmed with your counsel.

Its evidence ledger maps audit reports, invariant suites and contract configuration drift checks to 12 CFR 15.13(b).

In the same ledger, its privileged role and upgrade path map is tied to GENIUS section 4(a)(6).

Frequently Asked Questions

When does the GENIUS Act take effect?

January 18, 2027, 18 months after enactment. The Act's other trigger, 120 days after the first final rules, falls later, because the OCC's rule came in October 2026.

Did regulators meet the GENIUS Act rulemaking deadline?

No. Section 13(a) set July 18, 2026. The OCC issued the first final issuer rule on October 21, 2026; the FDIC, NCUA and Federal Reserve rules are still proposals.

Can existing stablecoin issuers keep issuing after January 18, 2027?

Only as permitted issuers, or under a waiver. The OCC can grant one for up to 12 months if a substantially complete application is pending by January 18, 2027.

When do the GENIUS Act rules for exchanges start?

In two steps. From January 18, 2027, platforms may offer a foreign issuer's coin only if it can and will comply with lawful orders. From July 18, 2028, they may offer only permitted issuers' coins, subject to section 18.
